The EC Habitats Directive (1992) is interpreted to British Law as The Conservation (Natural Habitats, &c.) Regulations (1994) and is generally referred to as the “Habitats Regulations (1994)”.
Under Regulation 39 of the Habitats Regulations (1994), it is an offence to disturb a European Protected Species’ life cycle, annual cycle, or diurnal cycle. This includes the intentional capture, killing, or disturbing of a protected animal; and the damage or destruction of breeding or resting sites of a protected animal.
Tamar Consulting provide surveys to establish if and how a protected species is using a site or an area. We will then provide advice on avoidance, mitigation, compensation and enhancement of the site with respect to the planned use of the area and the species concerned.
